Welcome to ShipMarvel! By registering and using ShipMarvel, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. 

1. Acceptance of Terms 

Users who create ShipMarvel accounts or use ShipMarvel constitute acceptance and agreement to these Terms and Conditions (the “Terms”). If you do not agree with any part of the Terms, please cease using ShipMarvel immediately. 

2. Services Offered

ShipMarvel is an Order and Freight Management platform connecting users with third-party carriers. Our services include: 

  • Managing orders and processing freight; 
  • Accessing various carriers, including dedicated carriers available to all registered users; 
  • Tracking shipments and pushing notifications directly to users’ sales channels or marketplaces. 

3. User Accounts

To access and use ShipMarvel, you will be required to create a ShipMarvel account. You agree to provide accurate, current, and complete registration information and keep such information updated. 

4. Use of Services 

ShipMarvel is available only to individuals of legal age to incur binding obligations and have the authority to place shipping orders for either themselves or a represented entity. 

You are responsible for maintaining the accuracy of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your ShipMarvel account.

5. Prohibited Uses 

You MUST NOT use ShipMarvel to  

  • Ship Dangerous Goods (as classified under Australian and international laws, regulations, or carrier-specific rules) or prohibited items (including, without limitation, illegal substances, counterfeit goods, or items restricted by law or carrier rules); 
  • Engage in fraud, or violate any applicable laws or regulations.  

Breach may trigger immediate account suspension/termination. You bear sole and whole liability for resulting fines, damages, or claims. 

6. Payment

ShipMarvel provides access to various carriers. By depositing funds into your ShipMarvel account, you authorize ShipMarvel to charge this balance for shipping services. You are responsible for maintaining sufficient funds to cover all transactions. 

Our shipping services operate on a pay-as-you-go, per-label basis. A shipping label containing shipment details and an estimated price calculated from your declared package information (including weight and dimensions) is automatically generated by our ShipMarvel system. This estimated price is deducted immediately from your account balance upon your order. If your account balance becomes insufficient or reaches zero, shipping services will be automatically suspended until you deposit adequate funds. 

You are responsible for the accuracy and completeness of the package information you declare. If incorrect information is detected (such as under-declaration of weight or dimensions), additional fees may be deducted from your account balance. 

7. Reward Program

ShipMarvel offers a rewards incentive program (“Reward Program“) based on shipping volume. All rewards are non-transferable and subject to ShipMarvel’s discretion regarding program modifications or discontinuation. Rewards may be forfeited upon account termination for breach of the Terms. In the event of voluntary account termination by users, any remaining account balance (excluding incentives or reward points) will be refunded within 7 business days, while unused incentives/reward points are automatically voided. 

8. Privacy and Data Processing 

By using ShipMarvel, you agree to our collection, use, and storage of your personal information necessary for us to provide services within the ShipMarvel system. Your personal data will be processed in compliance with our Data Protection and Privacy Policy, available on ShipMarvel website. 

9. Intellectual Property 

All content displayed or derived from ShipMarvel, including but not limited to text, graphics, logos, and software, is the intellectual property of ShipMarvel or our licensors and is protected by intellectual property laws. 

10. Termination

You may terminate the account at any time by providing written notice to support@eiz.com.au. ShipMarvel reserves the right to terminate user accounts and forfeit reward points or incentives for breach of the Terms, fraud, misuse, or illegal activities.  

In the case of voluntary termination by users, all remaining account balances will be credited back to the users, subject to deduction of any unpaid fees, charges, or amounts owed to ShipMarvel. 

11. Limitation of Liability 

ShipMarvel acts solely as an intermediary platform providing access to third-party carriers. ShipMarvel shall not be liable for any delays, losses, damages, misdeliveries, or other issues arising from or related to the services performed by carriers. Where liability cannot be excluded by applicable law, ShipMarvel’s total liability for any claims directly or indirectly arising from carrier services shall be strictly limited to the actual freight charges paid by you for the specific shipment giving rise to the claim. 

You ACKNOWLEDGE AND AGREE that: 

  • Carriers are independent contractors with their own terms, conditions, and limitations of liability governing their services;  
  • Your use of any carrier’s services is subject to and bound by that carrier’s terms; 
  • ShipMarvel does not assume, and hereby disclaims, any liability that a carrier may bear under its own terms. 

12. Modifications  

We may amend these Terms at any time. Material changes will be notified via the platform/email. Your continued use of ShipMarvel constitutes acceptance of the new terms. 

13. Dispute Resolution and Governing Law  

If you have any disputes with our services or platform, you agree to first contact our customer support team within 7 business days of a dispute arising. If the dispute is not resolved through negotiation, either party may submit the matter to the courts of Victoria, Australia. The Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
