Welcome to ShipMarvel! By registering and using ShipMarvel, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

Users who create ShipMarvel accounts or use ShipMarvel constitute acceptance and agreement to these Terms of Use (the “Terms”). If you do not agree with any part of the Terms, please cease using ShipMarvel immediately.

2. Services Offered

ShipMarvel is an Order and Freight Management platform connecting users with third-party carriers. Our services include:

  • Managing orders and processing freight;
  • Accessing various carriers, including dedicated carriers available to all registered users;
  • Tracking shipments and pushing notifications directly to users’ sales channels or marketplaces.

3. User Accounts

To access and use ShipMarvel, you will be required to create a ShipMarvel account. You agree to provide accurate, current, and complete registration information and keep such information updated.

4. Use of Services

ShipMarvel is available only to individuals of legal age to incur binding obligations and have the authority to place shipping orders for either themselves or a represented entity.

You are responsible for maintaining the accuracy of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your ShipMarvel account.

5. Prohibited Uses

You MUST NOT use ShipMarvel to

  • Ship Dangerous Goods (as classified under Australian and international laws, regulations, or carrier-specific rules) or prohibited items (including, without limitation, illegal substances, counterfeit goods, or items restricted by law or carrier rules);
  • Engage in fraud, or violate any applicable laws or regulations.

Breach may trigger immediate account suspension/termination. You bear sole and whole liability for resulting fines, damages, or claims.

6. Charges and Payment

ShipMarvel operates on a pay-as-you-go, per-label basis. Each shipping label you generate consists of one label credit and a freight charge.

Note: “ShipMarvel Freight Charge” applies only to shipments using ShipMarvel‑provided carriers. If you use your own carrier account, the freight charge is billed directly by that carrier – ShipMarvel is not involved. ShipMarvel does not charge, collect, or handle any refunds or disputes related to those charges – you must contact your carrier directly.

7. Referral Program

ShipMarvel offers a referral program (the “Referral Program”) that enables eligible users to earn label credits by referring new users to register for and use ShipMarvel services. The details of the Referral Program are set forth in the Referral Program Terms. By participating in the Referral Program, you agree to be bound by and comply with the Referral Program Terms.

8. Declaration Accuracy

You are responsible for providing accurate and complete package information you declare (e.g., weight, dimensions, etc.). If incorrect information is detected (such as under-declaration of weight or dimensions), any additional fees charged by the carrier may be deducted from your ShipMarvel account balance (for ShipMarvel-provided carriers) or billed directly by your own carrier.

9. Privacy and Data Processing

By using ShipMarvel, you agree to our collection, use, and storage of your personal information necessary for us to provide services within the ShipMarvel system. Your personal data will be processed in compliance with our Data Protection and Privacy Policy, available on ShipMarvel website.

10. Intellectual Property

All content displayed or derived from ShipMarvel, including but not limited to text, graphics, logos, and software, is the intellectual property of ShipMarvel or our licensors and is protected by intellectual property laws.

11. Termination

You may terminate the account at any time by providing written notice to support@eiz.com.au. ShipMarvel reserves the right to terminate user accounts and forfeit reward points or incentives for breach of the Terms, fraud, misuse, or illegal activities.

In the case of voluntary termination by users, all remaining account balances will be credited back to the users, subject to deduction of any unpaid fees, charges, or amounts owed to ShipMarvel.

12. Limitation of Liability

ShipMarvel acts solely as an intermediary platform providing access to third-party carriers. ShipMarvel shall not be liable for any delays, losses, damages, misdeliveries, or other issues arising from or related to the services performed by carriers. Where liability cannot be excluded by applicable law, ShipMarvel’s total liability for any claims directly or indirectly arising from carrier services shall be strictly limited to the actual freight charges paid by you for the specific shipment giving rise to the claim.

13. Carrier Acknowledgment

ShipMarvel works with the following third‑party carriers (this list and the carrier terms may be updated from time to time):

You ACKNOWLEDGE AND AGREE that:

  1. Carriers are independent contractors with their own terms, conditions, and limitations of liability governing their services;
  2. Your use of any carrier’s services is subject to and bound by that carrier’s terms. You may only use the corresponding freight services after expressly accepting the carrier’s terms;
  3. Carrier terms are provided as links above. Carriers may amend their terms without notice to ShipMarvel. We do not guarantee that the links shown are always the most current. You are still bound by the carrier’s actual current terms when using its services;
  4. If a carrier amends its terms and you do not accept the changes, you must notify us at support@eiz.com.au before your next use of that carrier. If you continue using the carrier’s services after the change without notifying us, you will be deemed to have accepted the updated terms;
  5. ShipMarvel does not assume, and hereby disclaims, any liability that a carrier may bear under its own terms.

14. Modifications

We may amend these Terms at any time. Material changes will be notified via the platform/email. Your continued use of ShipMarvel constitutes acceptance of the new terms.

15. Dispute Resolution and Governing Law

If you have any disputes with our services or platform, you agree to first contact our customer support team within 7 business days of a dispute arising. If the dispute is not resolved through negotiation, either party may submit the matter to the courts of Victoria, Australia. The Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
